The Agency was given the power to introduce the Scheme by the Industrial Relations (Northern Ireland) Order 1992, as amended, and the Fair Employment and Treatment (Northern Ireland) Order 1998. Subsequently, the Scheme has been established by means of the Labour Relations Agency Arbitration Scheme Order (Northern Ireland) 2012.

This guide is for employers and non-union workplace representatives. It gives advice on the provision of time off, training and facilities to enable non-union representatives to carry out their duties. It covers statutory and non-statutory representatives.

The Agency has a duty to provide practical guidance on the application of Articles 39 and 40 of the Industrial Relations (Northern Ireland) Order 1992 (“the 1992 Order”) in relation to the disclosure of information by employers to trade unions for the purpose of collective bargaining.

The last number of years has been a fallow period in terms of new employment legislation in Northern Ireland, which has seen a growing divergence between employment law here and in Great Britain. 

We are joined by Ciara Fulton, Partner and Head of law firm Lewis Silkin in Northern Ireland where she works in their Employment, Immigration and Reward division, and Patricia Coulter, Employment Relations Manager and Knowledge guru at the Labour Relations Agency, to look at the contents of the Department for the Economy's "Good Jobs" Employment Rights Bill consultation.
